Terms of sale

These terms govern every order placed with Arnaut Belcour through arnautbelcour.com. By placing an order, you accept them. We may update them from time to time; the version in force at the moment you order is the one that applies to your order.
1. Seller
Arnaut Belcour, a simple partnership under Swiss law (Art. 530 et seq. CO), Schulgasse 14, 4106 Therwil, Switzerland.

2. Scope
These terms apply to consumers ordering for personal use. Wholesale and business-to-business orders are handled by separate agreement; please write to us first.
3. How an order becomes a contract
The product pages, look-book, and prices on the site are an invitation to order, not a binding offer. You place an order by completing the checkout. We confirm receipt of your order by email. A binding contract comes into existence when we send a separate dispatch confirmation, or – for a made-to-order item – when we confirm we have started production.
We may decline an order in obvious cases: pricing error, stock exhausted, suspected fraud, or a shipping address we cannot serve. If we decline, any amount charged is refunded in full.
4. Reservation deposit (pre-launch)
Before the first production run ships, a piece can be held for you against a non-binding reservation deposit of CHF 2. The deposit reserves your size in your chosen cloth; it does not in itself conclude a contract of sale.
At launch we write to the email used at reservation with the final price (currently CHF 160) and confirm the shipping address. The CHF 2 deposit is credited toward your final order in full. You may cancel the reservation at any time before launch and we refund the deposit without deduction – write to contact@arnautbelcour.com. If we cannot produce your piece (cloth withdrawn, run cancelled), we refund the deposit on our own initiative.
5. Prices
Prices are shown in Swiss Francs (CHF). Arnaut Belcour is not registered for Swiss value-added tax (VAT); no VAT is charged or shown. For shipments outside Switzerland, taxes, duties, and import fees in the destination country are the buyer's responsibility unless expressly stated otherwise at checkout. Shipping costs are displayed before you confirm your order.
6. Payment
Payment is taken at checkout. We accept the methods shown on the payment step (typically major credit and debit cards, and any wallet providers offered by our payment processor). Payments are handled by Stripe Payments Europe, Ltd.; we do not see or store full card numbers.
7. Delivery
We ship from Switzerland. Standard dispatch is within five working days of order confirmation; made-to-order pieces take longer and the production window is stated on the product page. Carriers are Swiss Post and selected international partners. Risk passes to you on handover to the carrier; for shipments to consumers in the EU, risk passes when the goods are physically delivered to you.
Delivery times shown at checkout are best estimates, not guaranteed dates. If we anticipate a material delay, we write to you.
8. Returns and right of withdrawal
Switzerland does not grant a statutory right of withdrawal for online purchases. We offer a voluntary return window all the same; the terms are set out in our returns policy.
Consumers ordering from within the European Union benefit from the statutory 14-day right of withdrawal under EU consumer law. The returns policy explains how to exercise it.
9. Warranty and liability
We are liable for material defects according to Articles 197 ff. of the Swiss Code of Obligations (Sachgewährleistung). If a garment shows a defect on arrival, write to contact@arnautbelcour.com within a reasonable period – at the latest within two years of delivery. We will, at our discretion, repair the piece, replace it, or refund it.
The warranty does not cover wear from normal use, alterations carried out by third parties, or damage caused by failure to follow the care instructions on the label.
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, and wherever Swiss law does not permit a limitation. For slightly negligent breaches we are liable only for foreseeable damage typical of this kind of contract, and our total liability for such damage is limited to the price of the order concerned. Liability for indirect or consequential loss is excluded to the extent permitted by law. Mandatory consumer-protection and product-liability rules are unaffected.
10. Care and alterations
The care label inside each garment is binding. Hem alterations carried out by us are made to the measurements you give and cannot be undone – pieces with custom hems are excluded from the voluntary return window. Alterations carried out by third parties are at your risk.
11. Customer accounts
An account is not required to order but lets you save your fit profile and order history. You are responsible for keeping your sign-in credentials confidential. We may suspend accounts that are misused.
12. Intellectual property
All content on the site – text, photographs, drawings, patterns, the wordmark, the layouts – is the property of Arnaut Belcour or its licensors and is protected by Swiss and international copyright. You may not reproduce or use it commercially without our written consent.
13. Data protection
How we handle personal data is described in our privacy policy.
14. Force majeure
We are not liable for failure or delay in performance to the extent caused by events outside our reasonable control – including strikes, transport disruption, customs delays, supplier failure, fire, flood, or epidemic.
15. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in force. The invalid provision is replaced by a provision that comes closest to its commercial intent.
16. Applicable law and place of jurisdiction
These terms and any contract concluded under them are governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Therwil, Canton of Basel-Landschaft, Switzerland, subject to mandatory consumer jurisdictions that grant you a more favourable forum.
These terms are effective as of the date shown above and apply to every order placed from then on.
