Terms of sale

These terms govern every order placed with Arnaut Belcour through arnautbelcour.com. By placing an order, you accept them. We may update them from time to time; the version in force at the moment you order is the one that applies to your order.
We deliver within Switzerland. Delivery to the European Union opens with the first release; every provision below that speaks of EU delivery applies from that date.
1. Seller
Arnaut Belcour, a simple partnership under Swiss law (Art. 530 et seq. CO), Switzerland.

2. Scope
These terms apply to consumers ordering for personal use. Wholesale and business-to-business orders are handled by separate agreement; please write to us first.
3. How an order becomes a contract
The product pages, look-book, and prices on the site are an invitation to order, not a binding offer. You place an order by completing the checkout. We confirm receipt of your order by email. A binding contract comes into existence when we send a separate dispatch confirmation, or when we confirm we have started production of your piece.
We may decline an order in obvious cases: pricing error, stock exhausted, suspected fraud, or a shipping address we cannot serve. If we decline, any amount charged is refunded in full.
4. Reservation deposit (pre-launch)
Before the first production run ships, a piece can be held for you against a reservation deposit of CHF 2 – for EU reservations, EUR 2. The deposit reserves your size in your chosen cloth; it does not in itself conclude a contract of sale.
At launch we write to the email used at reservation with the final price – CHF 175 for delivery in Switzerland, EUR 195 for delivery to the EU, delivery included – and confirm the shipping address. The deposit is credited toward your final order in full, in the currency of that order. If we cannot produce your piece (cloth withdrawn, run cancelled), we refund the deposit on our own initiative.
You can cancel a reservation at any time before launch and we refund the deposit in full – see the returns page. If you are a consumer in the European Union, your statutory right of withdrawal remains unaffected in addition.
5. Prices
Prices for delivery in Switzerland are shown in Swiss Francs (CHF); prices for delivery to the European Union are shown in Euro (EUR). The price you see is the price you pay – delivery is included, and there is no separate shipping line at checkout.
For deliveries within Switzerland, Arnaut Belcour is not registered for Swiss value-added tax; no Swiss VAT is charged or shown.
For deliveries to the European Union, the price includes delivery, customs clearance, customs duties, and the import VAT due in the country of destination. Nothing further is collected from you on delivery.
6. Payment
Payment is taken at checkout. We accept the methods shown on the payment step – typically major credit and debit cards, and the further methods our payment processor offers there. Payments are handled by Stripe Payments Europe, Ltd.; we do not see or store full card numbers.
7. Delivery
We ship from Switzerland. Standard dispatch is within five working days of order confirmation; where a piece is first produced for you, dispatch takes longer and we write to you with the expected window. Within Switzerland the carrier is Swiss Post. For EU deliveries, the carrier and the expected delivery window are stated in your dispatch email. Risk passes to you on handover to the carrier; if you are a consumer in the European Union, risk passes when the goods are physically delivered to you.
Delivery times shown at checkout are best estimates, not guaranteed dates. If we anticipate a material delay, we write to you.
8. Returns and right of withdrawal
Switzerland does not grant a statutory right of withdrawal for online purchases. We offer a voluntary fourteen-day return window all the same; the terms are set out in our returns policy.
If you are a consumer in the European Union, you have the statutory right to withdraw from the contract within fourteen days without giving any reason. You bear only the direct cost of the return shipment; the returns policy explains the practical steps.
9. Warranty and liability
For deliveries in Switzerland, we are liable for material defects according to Articles 197 ff. of the Swiss Code of Obligations. If a garment shows a defect, write to contact@arnautbelcour.com within a reasonable period – at the latest within two years of delivery. We will first repair the piece or replace it. If both fail, or if waiting for either is unreasonable for you, the choice is yours: send the piece back for a full refund, or keep it and receive a partial refund that reflects the defect.
If you are a consumer in the European Union, the statutory warranty rights of the law of your country of habitual residence apply and are not limited by these terms. For Germany that means: if the piece is defective, you may at your choice require repair or a replacement; if that fails, is refused, or is unreasonable, you may reduce the price or withdraw from the contract, and claim damages where the law provides. Claims become time-barred two years from delivery, and in the first twelve months a defect is presumed to have existed at delivery.
The warranty does not cover wear from normal use, alterations carried out by third parties, or damage caused by failure to follow the care instructions on the label.
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, and wherever Swiss law does not permit a limitation. For slightly negligent breaches we are liable only for foreseeable damage typical of this kind of contract, and our total liability for such damage is limited to the price of the order concerned. Liability for indirect or consequential loss is excluded to the extent permitted by law. Mandatory consumer-protection and product-liability rules are unaffected.
10. Care and alterations
The care label inside each garment is binding. Hem alterations carried out by us are made to the measurements you give and cannot be undone – pieces with custom hems are excluded from the voluntary return window. Pieces delivered to the European Union are supplied at the standard inside leg length; we do not shorten hems for EU deliveries. Alterations carried out by third parties are at your risk.
11. Customer accounts
An account is not required to order but lets you save your fit profile and order history. You are responsible for keeping your sign-in credentials confidential. We may suspend accounts that are misused.
12. Intellectual property
All content on the site – text, photographs, drawings, patterns, the wordmark, the layouts – is the property of Arnaut Belcour or its licensors and is protected by Swiss and international copyright. You may not reproduce or use it commercially without our written consent.
13. Data protection
How we handle personal data is described in our privacy policy.
14. Force majeure
We are not liable for failure or delay in performance to the extent caused by events outside our reasonable control – including strikes, transport disruption, customs delays, supplier failure, fire, flood, or epidemic.
15. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in force. The invalid provision is replaced by a provision that comes closest to its commercial intent.
16. Applicable law and place of jurisdiction
These terms and any contract concluded under them are governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in the European Union, this choice of law does not deprive you of the protection of the mandatory rules of the law of your country of residence, and you may bring or defend proceedings before the courts of your own domicile. Otherwise the place of jurisdiction is Therwil, Canton of Basel-Landschaft, Switzerland.
17. Dispute resolution
We are not obliged and not willing to take part in dispute-resolution proceedings before a consumer arbitration board. The fastest way to a solution is contact@arnautbelcour.com.
These terms are effective as of the date shown above and apply to every order placed from then on.
